12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For disputes with consumers resident in the EU, mandatory consumer protection laws of their country of residence remain unaffected.

For all other users, the courts of Berlin, Germany shall have non‑exclusive jurisdiction.

13. Dispute Resolution

Informal Negotiations

The parties will attempt to resolve disputes informally for at least 30 days before starting formal proceedings. Informal negotiations begin when one party sends written notice to the other.

Binding Arbitration (for non‑consumer disputes)

For disputes not involving EU consumers acting in a personal capacity, any unresolved dispute shall be finally settled by a single arbitrator under the Arbitration and Internal Rules of the European Court of Arbitration.

Arbitration will be on an individual basis only; no class actions or representative proceedings are permitted.

Exceptions

The following are excluded from informal negotiation and arbitration:

• Disputes concerning intellectual property rights.

• Disputes involving theft, piracy, invasion of privacy, or unauthorised use.

• Claims for injunctive or equitable relief.

EU consumers retain their statutory rights to bring claims before their local courts.

14. Corrections

The Site may contain typographical errors, inaccuracies, or omissions (e.g., in descriptions, pricing, or availability). We reserve the right to correct such errors and update information at any time without prior notice.

15. Disclaimer of Warranties

The Site and all services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non‑infringement, to the fullest extent permitted by law.

This information is for general educational purposes only and is not tailored to your specific plants, environment, or conditions. We do not guarantee its accuracy, completeness, or suitability for your situation.

No Guarantee of Plant Health
We are not liable for any damage, loss, or adverse effects resulting from applying our recommendations, including but not limited to plant stress, disease, pest infestation, wilting, leaf discolouration, root rot, or plant death.

Your Responsibility
You are solely responsible for:

• Selecting appropriate plants for your conditions.

• Providing suitable light, water, soil, temperature, and care.

• Seeking professional advice for specific issues, especially for valuable, rare, or sensitive plants.

No Professional Relationship
Use of the Site does not create a professional client relationship unless explicitly agreed in a separate written contract.

Indemnification
You agree to indemnify and hold us harmless from any claims, liabilities, costs, or expenses arising from your care, maintenance, or handling of plants based on information from the Site.

If you do not agree with these conditions, you must not rely on our plant‑care information or services.
